Short, honest, and binding. Like a pinky promise with a notary.You're buying a one-of-a-kind, pre-made brand kit — digital files, finished to your business name. It's sold once, ever. You approve a proof (48 hours), pay an invoice from Test Monki (48 hours), and your files arrive in your portal within about two months. All sales are final. On payment in full, the kit's brand identity becomes yours — you own it. The made-up business names aren't trademark-cleared — that's your homework. Now, the long version:
Sugar Monki is a product line of Test Monki, LLC ("Test Monki," "we," "us"), The Woodlands, Texas. Your invoice is issued by Test Monki, LLC. These Terms of Purchase govern every purchase of a Sugar Monki brand kit or extra item (together, the "Products"), and by pressing "I want it," submitting an order, or paying an invoice, you agree to them.
A Sugar Monki brand kit is a pre-made brand identity — a logo and supporting design files, finished with your business information. Kits are sold exactly once. Customization is limited to your basic business information (name, address, phone, web); no other design changes are included. Each kit's contents are listed on its wall card and delivered as described in the Nitty Gritty.
Kits are first come, first served; we do not hold kits. After you submit the "I want it" form, we confirm that your business name fits the design and send you a proof. You have 48 hours to approve it. If your name doesn't suit the design, or your submission doesn't pass our review, we may decline the order — the lab reserves the right to be picky. Information you submit must be accurate; changes requested after final delivery incur an additional fee.
On proof approval, Test Monki issues an invoice, payable in U.S. dollars within 48 hours. Texas purchasers: 8.25% Texas sales tax is added to the invoice. If the invoice isn't paid in time, the kit returns to availability. No files are delivered before payment in full. By providing a payment method you represent that you are authorized to use it. Chargebacks initiated in breach of these terms make you responsible for the original purchase amount plus fees we incur.
Finished files are delivered to your private client portal within approximately two months of payment in full, excluding holidays and studio closures. Rush delivery, where available, is quoted separately.
The Products are digital goods. All sales are final: no returns, no exchanges, no refunds, under any circumstances.
On payment in full, Test Monki assigns to you all copyright in your kit's finished brand identity — the logo, secondary marks, and finished design files. It's yours: one kit, one owner, forever. Excluded from the assignment are third-party materials (fonts and stock photography remain licensed by their owners under their own terms) and Test Monki's own tools, templates, and processes used to produce the kit. You may not resell or redistribute the kit (or its parts) as design assets — you bought a brand, not inventory.
Some kits are offered with a business name and domain (URL) — marked "name + url ready." For those, we have performed a preliminary trademark search and secured the domain as of the date shown on the kit; a preliminary search is not legal clearance, and we make no warranty that any name is or will remain available for your use, registrable, or free of conflicts. All other kit names are fictitious and provided as-is, with no search of any kind. In every case, you are solely responsible for final trademark clearance, registration, and legal review by qualified IP counsel before adopting any name, and Test Monki has no liability arising from your use of any name or domain.
Font licenses are not included and must be purchased separately from the foundry; your style guide lists sources and free alternatives. Stock photography included in a kit is licensed for that brand's use only and may not be extracted for other projects. Printing is not included, and we are not responsible for third-party printer output.
We reserve the right to display sold kits, including your finished brand, in our portfolio and marketing — on the wall, in case studies, and in promotional materials.
The Products are provided "as is," without warranties of any kind, express or implied. To the fullest extent permitted by law, Test Monki is not liable for indirect, incidental, or consequential damages arising from the Products or their use, and our total liability for any claim is capped at the amount you paid for the Product giving rise to it.
These terms are governed by the laws of the State of Texas. Any dispute will be resolved by binding arbitration in Montgomery County, Texas, with each party bearing its own costs and sharing arbitration fees equally.
